1. Service Description

Pulsentric is a Software-as-a-Service platform providing on-chain analytics, AI-powered sentiment analysis, whale tracking, smart-money signal generation, rug-pull detection, and related informational tooling for cryptocurrency markets.

Pulsentric expressly disclaims any status as a financial adviser, broker-dealer, or regulated financial entity under any applicable law. Specifically:

The Service incorporates outputs generated by Large Language Models (LLMs). Users acknowledge and accept the following inherent limitations:

4. Limitation of Liability

4.1 United States

To the maximum extent permitted by applicable law, Pulsentric, its affiliates, officers, employees, agents, and contractors shall NOT be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to: lost profits, lost data, loss of goodwill, business interruption, or cost of substitute services, arising out of or in connection with these Terms or the use of, or inability to use, the Service, even if Pulsentric has been advised of the possibility of such damages.

In no event shall Pulsentric's total aggregate liability to any user for all claims arising under or relating to these Terms exceed the greater of (a) the total fees paid by the user to Pulsentric in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US Dollars (USD $100).

4.2 European Union and European Economic Area

For users located in the European Union or the European Economic Area, Pulsentric's aggregate liability for direct damages arising from or in connection with the Service shall be limited to the total fees paid by the user to Pulsentric in the twelve (12) months preceding the event giving rise to the claim. Exclusions of liability for indirect or consequential damages apply to the fullest extent permitted under applicable EU member state law.

Nothing in this Section 4 shall limit or exclude liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; (iii) intent (dolo) or gross negligence (colpa grave) where exclusion is not permitted under mandatory applicable law; or (iv) any other liability that cannot lawfully be limited or excluded under applicable consumer-protection legislation, including rights conferred by the Italian Consumer Code (D.Lgs. 206/2005).

6. Termination and Refund Policy

Pulsentric reserves the right to suspend or terminate access to the Service, with or without notice, for any user who: (i) violates these Terms; (ii) engages in fraudulent, abusive, or unlawful activity; or (iii) poses a risk to the security, integrity, or reputation of the Service or other users.

Refund Policy: Subscription fees are non-refundable after a billing period has commenced, except as required by mandatory applicable law. For users located in the European Union: pursuant to Article 16(m) of Directive 2011/83/EU, the statutory 14-day right of withdrawal does not apply to the supply of digital content commenced with the user's explicit prior consent and acknowledgment that the right of withdrawal is thereby waived. Pulsentric collects such consent at checkout. Where mandatory national consumer law grants additional rights, those rights are not affected by this clause.

Upon termination for any reason, users may request a data export before account deletion. Pulsentric will process such requests within thirty (30) days.

7. Governing Law and Dispute Resolution

B2C (Consumer) Users — EU/EEA: These Terms shall be governed by the laws of the Republic of Italy. Disputes shall be subject to the non-exclusive jurisdiction of the courts of Italy. Consumer users residing in an EU/EEA member state retain the right to bring proceedings before the courts of their country of domicile and to access any applicable out-of-court dispute resolution (ODR) mechanism provided under EU law.

B2B (Business) Users — International: At Pulsentric's option, disputes arising from or relating to the Enterprise API or any B2B agreement may be governed by the laws of the State of Delaware, USA, with exclusive jurisdiction in the courts of Delaware, to the extent permitted by applicable law.

The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

8. Changes to These Terms

Pulsentric may revise these Terms of Service at any time. For material changes, registered users will receive advance notice via email and/or a prominent in-app banner at least seven (7) days before the changes take effect (or thirty (30) days where required by applicable consumer law). Continued use of the Service after the effective date of any revised Terms constitutes acceptance of those Terms. If you do not agree to the revised Terms, you must cease using the Service and cancel your subscription prior to the effective date.
